Renewed claims that the Justice Department is preparing to arrest former President Barack Obama have spread online, but available reporting does not show that Obama has been charged or arrested.
The claims appear connected to a broader Justice Department investigation examining whether former government officials improperly targeted Donald Trump during earlier federal investigations.
That investigation has focused particularly on the 2016 intelligence assessment concerning Russian interference in the presidential election and the later investigation into classified documents at Trump’s Mar-a-Lago residence.
Obama has become a prominent figure in the controversy because Trump and his allies have repeatedly accused his administration of improperly handling intelligence surrounding Russia’s efforts to influence the 2016 election.
In July 2025, then-Director of National Intelligence Tulsi Gabbard released documents and alleged that senior Obama administration officials had manipulated intelligence to undermine Trump.
Gabbard referred the material to the Justice Department and publicly called for prosecution, while Trump subsequently described the allegations as evidence of what he called treason.
However, FactCheck.org reported that Gabbard’s interpretation conflated intelligence assessments about Russia’s inability to alter voting infrastructure with separate assessments documenting Russia’s attempts to influence the election.
The bipartisan Senate Intelligence Committee had previously concluded that Russia interfered in the 2016 election and found the intelligence community’s assessment of that interference to be supported by the evidence.
In August 2025, Reuters reported that Attorney General Pam Bondi had directed federal prosecutors to launch a grand-jury investigation into allegations involving members of the Obama administration.
That investigation, however, concerned allegations involving Obama-era officials and did not amount to a criminal indictment of Barack Obama himself.
The issue returned to national attention in 2026 after Trump repeatedly called for Obama’s arrest and accused the former president of treason without publicly establishing evidence supporting those accusations.
In May, The Washington Post reported that Trump had shared a social-media post calling for Obama and others to be arrested, prosecuted and imprisoned over allegations connected to the Russia investigation.
More recently, the Justice Department investigation itself has experienced internal turbulence, including the September departure of prosecutor Joseph diGenova, who had been overseeing the inquiry into Obama- and Biden-era officials.
Reuters subsequently reported that Kurt Olsen, another Justice Department lawyer involved in the investigation, also left the inquiry, adding uncertainty to its direction and progress.
The investigation has examined whether former federal law-enforcement and intelligence officials conspired against Trump, including their handling of the Russia assessment and the Mar-a-Lago investigation.
Recent reporting has described the broader theory as a “grand conspiracy” investigation, but prosecutors have not publicly announced criminal charges against Obama based on that inquiry.
The distinction between an investigation, a criminal referral and an indictment is significant. A referral asks prosecutors to consider possible criminal conduct, while an indictment requires a grand jury to formally charge a defendant.
Similarly, allegations of treason, espionage or seditious conspiracy are not equivalent to evidence that those crimes have been established against a particular person.
Obama’s representatives have rejected the accusations, describing the claims as unfounded and maintaining that nothing released by the Trump administration has overturned established findings concerning Russian interference in 2016.
Previous investigations, including the Mueller investigation and the bipartisan Senate Intelligence Committee review, concluded that Russia attempted to interfere in the 2016 election, while finding no evidence that Trump’s campaign conspired with the Russian government.
For now, therefore, the most significant confirmed development is the continuing Justice Department investigation into former officials—not a publicly announced indictment or arrest of Barack Obama.
