Seven U.S. States Restrict Lab-Grown Meat as Cultivated Food Faces Growing Political and Legal Pushback

WASHINGTON — Seven U.S. states have enacted laws restricting or temporarily banning cultivated meat, creating a fragmented regulatory landscape for an industry still developing nationally.

The states are Alabama, Florida, Indiana, Mississippi, Montana, Nebraska and Texas, according to a 2026 review of state-level cultivated-meat legislation.

However, describing all seven measures simply as permanent “bans” is misleading. Several states prohibit sales outright, while Indiana and Texas adopted temporary restrictions with defined expiration dates.

Cultivated meat is produced by growing animal cells in controlled facilities rather than raising and slaughtering an entire animal, offering a fundamentally different production method for meat products.

Florida and Alabama were the first states to enact statutory bans, doing so in 2024 as lawmakers moved to restrict commercial production, sales, distribution or possession of cultivated meat.

Florida’s current statute makes manufacturing for sale, selling, holding for sale and distributing cultivated meat unlawful, with penalties applying to knowing violations under state law.

Alabama similarly enacted legislation prohibiting the production, sale, holding for sale and distribution of cultivated food products, making it one of the earliest states adopting comprehensive restrictions.

In 2025, Mississippi, Montana and Nebraska added broader prohibitions, while Indiana and Texas introduced temporary measures limiting cultivated-meat sales and manufacturing.

Indiana’s law prohibits selling, offering for sale or manufacturing cultivated meat from July 1, 2025, through June 30, 2027, establishing a two-year statutory moratorium.

Texas also adopted a temporary restriction, with its measure prohibiting the sale or offering for sale of cell-cultured protein through September 1, 2027.

The growing patchwork has created different rules across state borders, with some jurisdictions banning products while others regulate terminology, labeling, procurement or government funding.

A 2026 academic review found that nine states had either banned cultivated products or restricted state funding, while 21 states had enacted labeling requirements.

These distinctions matter because cultivated meat remains subject to federal oversight. The USDA and FDA share regulatory responsibilities for cultivated meat and seafood products in the United States.

The federal government has previously cleared cultivated meat products for sale, including cultivated chicken, following safety reviews conducted by federal regulators.

Supporters of state restrictions generally frame the measures around consumer protection, labeling, agricultural policy and concerns about how cultivated products should be classified under existing food laws.

Industry representatives and some critics of the bans argue that state-level prohibitions could limit consumer choice, discourage innovation and create barriers for companies operating across multiple markets.

Legal challenges are also developing. Companies and industry groups have challenged some state restrictions, raising questions involving interstate commerce, federal authority and potential conflicts between state and federal regulation.

The debate has also attracted attention from politicians and food-policy advocates who disagree sharply about whether cultivated meat represents technological progress or an unnecessary challenge to conventional agriculture.

Despite the political controversy, cultivated meat remains a small emerging sector rather than a major component of the American food supply, and commercial availability remains limited.

For consumers, the immediate result is a complicated national landscape: a cultivated product permitted under federal rules may nevertheless face additional restrictions depending on the state where it is produced or sold.

The seven-state figure is therefore accurate when referring to enacted state restrictions, but calling every measure a permanent “ban” overlooks important differences between outright prohibitions, temporary moratoriums and narrower regulations.
