There is a real investigation behind the controversy. House Republicans did investigate Biden’s use of the autopen, and their October 2025 report raised serious questions about how some executive actions were authorized.
But the much more dramatic claim in the graphic — that a Democratic politician was “caught” faking Biden’s signatures — is not supported by the evidence.
The person apparently being referenced is Sen. Elizabeth Warren, based on an allegation made publicly in May 2025 by former Trump administration AI and cryptocurrency adviser David Sacks.
There is a major difference between being accused and being caught.
Where the Elizabeth Warren Allegation Came From
On May 27, 2025, Sacks appeared on Fox News and claimed that Warren had controlled Biden's autopen during his administration.
Sacks connected the allegation to Warren's opposition to cryptocurrency and argued that she had exercised excessive influence over Biden-era crypto policy. The Washington Examiner reported his comments at the time.
That is the origin of the claim that a prominent Democrat was behind Biden's autopen.
But Sacks did not present documentary evidence showing Warren operating the machine.
Nor did he produce evidence that she personally authorized particular Biden executive orders, pardons or other presidential actions.
And there is an important detail the viral graphic leaves out:
Elizabeth Warren was not the person House investigators publicly identified as an autopen operator.
House Investigators Were Looking at Biden White House Staff
The House Oversight Committee launched its investigation into Biden's autopen use in May 2025.
Chairman James Comer said investigators believed they had identified staffers involved in operating the device. He did not identify Elizabeth Warren as the person operating it.
Comer later said the committee was starting with several Biden White House officials and wanted to determine who authorized the use of the autopen and who was actually making decisions.
The officials publicly identified for interviews included Neera Tanden, Annie Tomasini, Anthony Bernal and Ashley Williams.
That is a very different group from Warren.
Warren was a Democratic senator from Massachusetts — not a Biden White House staff secretary or presidential aide.
What the House Investigation Actually Found
The Republican-led House Oversight Committee eventually released its report, “The Biden Autopen Presidency: Decline, Delusion, and Deception in the White House,” on October 28, 2025.
The committee argued that Biden's senior advisers and aides had exercised presidential authority without adequate documentation showing that Biden personally authorized certain actions. It specifically criticized the use of the autopen for executive orders and clemency decisions.
The committee's report focused heavily on Biden's inner circle and the procedures used to authorize the machine.
It did not establish that Elizabeth Warren secretly controlled the autopen.
That distinction is crucial.
The Report Did Raise Genuine Questions About Authorization
This does not mean the entire autopen controversy was fabricated.
There were legitimate questions about how the device was used.
The Oversight Committee's report cited testimony and emails concerning the approval process for Biden's final pardons. According to the committee, former Chief of Staff Jeff Zients did not personally know who ultimately operated the autopen after authorization had been communicated through an aide. The committee argued that there was insufficient contemporaneous documentation tracing those actions directly to Biden.
The committee consequently recommended that the Justice Department investigate Biden's executive actions, particularly clemency decisions, to determine whether Biden personally authorized them.

But it still doesn't establish the viral graphic's allegation about Warren.
Biden's Use of an Autopen Wasn't Secret
Another important piece of context is that the use of an autopen by presidents is not itself illegal or unprecedented.
The Justice Department's Office of Legal Counsel concluded in 2005, during the George W. Bush administration, that a president could direct that his signature be affixed to legislation using an autopen. Presidents before Biden had used the technology as well.
The legal question is therefore not simply:
“Was an autopen used?”
The much harder question is:
“Did the president authorize the action for which the autopen was used?”
That is why the Biden controversy became focused on authorization and decision-making rather than the mere existence of a mechanical signature.
Biden Says He Made the Decisions
